Workers' Compensation

Picture

Generally speaking, if an employee is injured while on the job or is hurt while traveling for work, that employee is entitled to worker’s compensation benefits. Workers’ compensation benefits can be paid in one of two ways by an employer: directly to the employee or through an insurance company.

Workplace injuries—such as forklift accidents, injuries involving equipment that employees use daily, or slips and falls from a ladder or a roof—often cause debilitating and constant back and neck-related pain. Chiropractors can help with these types of injuries; they are specifically licensed and trained to treat them.

Visiting a chiropractor is an excellent way to deal with injuries and other workers’ compensation issues. If an employee has suffered from an injury while on the job and went down the traditional road to receive medical treatment—as in, visited an urgent care center or general practice doctor—and found that it isn’t working out, it might be time to give a chiropractor a try. Chiropractors are medical professionals who are well versed in dealing with the underlying issues that could’ve been looked over by a general practice doctor. Locating the exact source of the injury could make all the difference between solving the issue or having to live with it for a long time to come.

In addition to being experts at uncovering the underlying reasons for pain, chiropractors often take care of the healing process, too. And they don’t administer or recommend addictive pain pills or risky surgeries. Scheduling that initial consultation with a chiropractor is highly recommended if an employee has been injured while on the job.

About workers' compensation - Workers' compensation is a no-fault system designed to provide benefits to employees who are injured as a result of their employment activities. It also helps limit the liability of employers. Because it is a no-fault system, the employee does not need to prove negligence on the part of the employer to establish liability. It also means the employer cannot use negligence on the part of the employee as a defense to a claim.
A work-related injury can be any condition that is caused, aggravated or accelerated by the employment activities. This includes traumatic injuries, repetitive type injuries, occupational diseases and qualifying mental injuries, such as post-traumatic stress disorder (PTSD). The employee needs to show only that the employment activities were a substantial contributing factor to the disability and/or need for medical care.

Basic benefits - Workers' compensation provides three basic types of benefits:  wage loss, medical and vocational rehabilitation.

The Minnesota workers' compensation statutes entitle an injured employee to reasonable and necessary medical treatment or supplies to cure or relieve the effects of the work injury. The employer is required to furnish medical treatment as described by Minnesota Statutes 176.135, subd. 1, including psychological, chiropractic, podiatric, surgical and hospital treatment.
